Women wishing hospital admission for childbirth are asked to sign very general pre-admission consent forms. The use of such forms suggests that women in labor are considered incompetent to give informed consent. This paper explores some of the problems with advance directives and general consent, and argues that since women in labor are not generally incompetent, it is not appropriate to require this kind of consent of them.

Despite the much-discussed court cases in the 1970s that permitted some sibling-to-sibling kidney donations from minors,1 principles that can guide parental, medical, or judicial decisionmaking are neither clearly articulated nor uncontroversial.

Adults who give proxy consent for medical treatment for adolescents must decide how much weight to give to adolescents' own preferences. There is evidence that some adolescents choose treatments different from what adults see as most reasonable. It is argued that adolescents choose according to age-specific values, i.e. values they hold, as adolescents, and which fulfil important developmental needs. Because not fulfilling these needs may do serious psychological damage, it is urged that proxies give weight to these values, up to (...) the limit where it would endanger or profoundly limit future life. Rosalind Hursthouse took her undergraduate degree in New Zealand and her B. Phil. and D. Phil. at Oxford. She taught in Oxford for six years before joining the Open University in 1975. As part of her work for the O.U. she has published Beginning Lives (Blackwell, 1987) on the morality of abortion; this generated Virtue theory and abortion, Philosophy and Public Affairs, 1991) which has already been reprinted five times. Virtue ethics is perhaps the most important development within late twentieth-century moral philosophy. Rosalind Hursthouse, who has made notable contributions to this development, here presents a full exposition and defense of her neo-Aristotelian version of virtue ethics. She shows how virtue ethics can provide guidance for action, illuminate moral dilemmas, and bring out the moral significance of the emotions.

In On Virtue Ethics I offered a criterion for a character trait's being a virtue according to which a virtuous character trait must conduce to, or at least not be inimical to, four ends, one of which is the continuance of the human species. I argue here that this does not commit me to homosexuality's being a vice, since homosexuality is not a character trait and hence not up for assessment as a virtue or a vice. Vegetarianism is not up (...) for such assessment either, for the same reason, but, as a practice, may well be required by the virtue of compassion, and sacrificing one's life for an animal or alien may be required by courage. The clause about the continuance of the human species in my criterion does not specify a foundational value, because, following McDowell, I reject foundationalism. (shrink)

The recent interest in systematic review methods in bioethics has highlighted the need for greater transparency in all literature review processes undertaken in bioethics projects. In this article, I articulate features of a good bioethics literature review that does not aim to be systematic, but rather to capture and analyse the key ideas relevant to a research question. I call this a critical interpretive literature review. I begin by sketching and comparing three different types of literature review conducted in bioethics (...) scholarship. Then, drawing on Dixon-Wood's concept of critical interpretive synthesis, I put forward six features of a good critical interpretive literature review in bioethics: answering a research question, capturing the key ideas relevant to the research question, analysing the literature as a whole, generating theory, not excluding papers based on rigid quality assessment criteria, and reporting the search strategy. Virtue ethics is currently one of three major approaches in normative ethics. It may, initially, be identified as the one that emphasizes the virtues, or moral character, in contrast to the approach that emphasizes duties or rules (deontology) or that emphasizes the consequences of actions (consequentialism). Suppose it is obvious that someone in need should be helped. A utilitarian will point to the fact that the consequences of doing so will maximize well-being, a deontologist to the fact that, in doing (...) so the agent will be acting in accordance with a moral rule such as “Do unto others as you would be done by” and a virtue ethicist to the fact that helping the person would be charitable or benevolent. According to the standard account of actions and their explanations, intentional actions are actions done because the agent has a certain desire/belief pair that explains the action by rationalizing it. Any explanation of intentional action in terms of an appetite or occurrent emotion is hence assumed to be elliptical, implicitly appealing to some appropriate belief. In this paper, I challenge this assumption with respect to the " arational " actions of my title---a significant subset of the set of intentional actions (...) explained by occurrent emotion. These actions threaten the standard account, not only by forming a recalcitrant set of counterexamples to it, but also, as we shall see, by undercutting the false semantic theory that holds that account in place. The purpose of this paper is to explore some of the moral problems that arise out of the interrelationships between individuals and formal organizations in our society. In particular, I shall be concerned with the moral implications of the so-called ideal of rationality of formal organizations with regard to, on the one hand, the obligations of individuals both inside and outside an organization to that organization and, on the other hand, the moral responsibilities of organizations to individuals and to the (...) public at large. I shall argue that certain facets of the organizational ideal are incompatible with the ordinary principles of morality and that the dilemma created by this incompatibility is one source of alienation in our contemporary, industrial society. The very conception of a formal organization or bureaucracy presents us with an ideological challenge that desperately needs to be met in some way or other. (shrink)

In the Australian state of Victoria, legislation allowing voluntary assisted dying (VAD) passed through parliament in November 2017. There was then an eighteen-month period before the start date for patient access to VAD, referred to as the “implementation period.” The implementation period was intended to allow time for the relevant government department and affected organizations to develop processes before the Act came into effect in June 2019. This qualitative interview study investigates the perspectives of a multidisciplinary sample of twelve clinicians (...) from a single metropolitan hospital during this implementation period. Maximum variation sampling was utilized to ensure breadth across discipline (medical, nursing, allied health), speciality, and stated level of support for the VAD legislation. Four key themes were identified from the interview data: preparing for the unknown, ethical diversity within the organization, building a respectful culture, and concerns about the inability of the legislated approach to capture clinical nuances. Overall, these clinicians’ workplace experiences during the implementation period were shaped by the ethical diversity within their organization and a sense of uncertainty about how the VAD legislation would integrate with the practical realities of their clinical setting. The concept of “ethical diversity” could be a useful one for supporting staff in an organization during a VAD implementation period. (shrink)

Most interpreters hold that Kant rejects actually infinite tota synthetica as conceptually impossible. This view is attributed to Kant to relieve him of the charge that the first antinomy’s thesis argument presupposes transcendental idealism. I argue that important textual evidence speaks against this view, and Kant in fact affirms the conceptual possibility of actually infinite tota synthetica. While this means the first antinomy may not be decisive as an indirect argument for idealism, it gives us a better account of how (...) our ideas of the unconditioned generate the antinomies, and it allows us to see important and often overlooked elements in Kant’s account of the infinite. Rosalind Hursthouse carefully introduces the three standard approaches in current ethical theory: utilitarianism, rights, and virtue ethics. She links each chapter to readings from key exponents such as Peter Singer and Mary Midgley and asks students to think critically about these readings for themselves. Models for clinical ethics case consultation often make reference to ‘balancing’ or ‘weighing’ moral considerations, without further detail. In this paper, we investigate balancing in clinical ethics case consultation. We suggest that, while clinical ethics services cannot resolve ongoing deep philosophical debates about the nature of ethical reasoning, clinical ethicists can and should be more systematic and transparent when balancing considerations in case consultations. We conceptualise balancing on a spectrum from intuitive to deliberative, and argue that good balancing in case (...) consultation involves articulating reasons for giving something more or less weight. We develop a framework of four practical strategies for better balancing in clinical ethics case consultation: intuitions as a launchpad, drilling down, pairwise comparison and group deliberation. By giving legislatures broad power to override constitutional rights provisions, recent Commonwealth rights charters are said to create a new ‘weaker’ model of constitutional rights protection than the traditional US model of strong-form judicial review. The article, however, argues that to date such powers have rarely if ever been used by Commonwealth legislatures, and thus have had little direct effect on the strength of judicial review in Commonwealth countries. At most, such powers may have had some indirect effect on the (...) strength of review in the Commonwealth, compared to the United States, by encouraging greater deference by courts such as the Supreme Court of Canada to attempts by parliament to engage in ‘dialogue’ via ordinary legislative means. This more limited—and contingent—view of Commonwealth–US constitutional difference also has clear practical implications, the article suggests, for ongoing attempts to ‘borrow’ or adopt the new Commonwealth constitutional model elsewhere. My thesis traces Russell's development of his theory of belief from 1913 to 1918 under the impact of his student, Ludwig Wittgenstein. ;In chapter one I focus on Russell's multiple relation theory of belief from 1910 to early 1913 and on Russell's view of perception as a relation between minds and objects. I show that, on Russell's theory, acts of believing or judging are intended to explain the different types of judgments and to account for how propositions acquire a complete (...) sense. I argue that Russell faces difficulties explaining the status of relations occurring in propositions which are believed, and that his account of how we perceive types of objects is in tension with his theory that beliefs are facts. ;In chapter two I examine Wittgenstein's influence on Russell's 1913 work, Theory of Knowledge. I argue that in Theory of Knowledge Russell responds to Wittgenstein's objections to his theory of judgment by proposing a theory of unnamable asymmetrical relations and unasserted mental relations. I further argue that Russell begins to see that, without postulating further judgments and thus entailing a vicious regress, his notion of perception cannot support an adequate account of distinctions between types of entities judged. I claim---with Sommerville and others---that Russell's "paralysis" in the face of Wittgenstein's criticisms in 1913 concerns his inability to explain judgment without explaining type distinctions and vice versa. ;In chapter three I examine the development of Russell's thought between 1914 and late 1918 in response to Wittgenstein. I suggest that in early 1918 Russell begins to accept Wittgenstein's claim that in belief-contexts, the proposition is a fact consisting of grammatical relations of words. I further claim that, unlike Wittgenstein, Russell explains all such relations by giving an account of our psychological needs and limitations. Finally I conjecture that Russell begins to be inclined to reject his relational conception of perception, and of belief as involving a subject, not only because he begins to take neutral monism more seriously, but also because of difficulties internal to his theory of perception, difficulties that Wittgenstein may have suggested to him.
